Terms of Use

If your account was created before 7 October 2026: these terms apply to you from 1 December 2026, and Part C, the creator terms, from 16 November 2026. Until then the previous terms (terms@2025-12-17) apply to you; they are published at quelper.com/terms/2025-12-17 until that date. You may already rely on any part of these terms that is more favourable to you.

In short

  • These terms are the contract between you and Quelper LLC. Part A applies to everyone, Part B when you buy, Part C when you sell as a creator, and Part D when you bring buyers or creators to Quelper.
  • Memberships, courses and digital products are sold to you by Quelper. Services and physical products come from the creator, who provides or sells them to you (section A2).
  • If you are a consumer, you can withdraw from a purchase within 14 days (section B5). Our 7-Day Satisfaction Guarantee gives you back in full the first payment of a membership if you ask within 7 days of it, with no questions asked (section B6). Both come on top of your other rights under the law.
  • Monthly memberships renew every month until you cancel, and you can cancel at any time (section B3).
  • What creators pay Quelper, how they are paid and how refunds affect them is in Part C (sections C3 to C5).
  • Questions, complaints and reports of illegal content: s.alekhin@quelper.com, or the support chat on Quelper when you are signed in.
  • Nothing in these terms takes away rights that the law of the country where you live gives you as a consumer and that a contract cannot exclude.

Part A — Everyone

A1. Who we are

Quelper (quelper.com) is run by Quelper LLC, a limited liability company organised under the laws of the State of Delaware, USA (Delaware Division of Corporations file number 10022353). Its registered office is at its registered agent, Legalinc Corporate Services Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, USA; this is also our postal address. Quelper is managed day to day from Madrid, Spain. In these terms, “Quelper”, “we” and “us” mean Quelper LLC, and “you” means the person using Quelper.

Contact: s.alekhin@quelper.com. If you have an account, you can also write to us in the support chat on any page of Quelper, which a person reads and answers. The email address is also our single point of contact for users and for authorities under Articles 11 and 12 of the EU Digital Services Act; you can write to us in English, Spanish or Russian. More company details are in our Legal Notice.

A2. What Quelper is and who you contract with

Quelper is a marketplace where independent creators offer communities, courses, digital products and services, and where people buy and join them. Who you contract with depends on what you buy:

  • Digital access — a membership of a community (monthly or a lifetime package), a course or a digital product — is sold to you by Quelper LLC. The creator makes the content and licenses it to us for this purpose (section C2). We are responsible to you for the sale, for giving you access and for your rights as a buyer.
  • Services that a creator provides to you personally — in person, live, or as files they make for you; for example a session, a lesson, a tour, a photo shoot or edited photos — are provided by the creator, under a contract between you and the creator. Quelper runs the marketplace and collects the payment for the creator as their agent: once you have paid through Quelper, you have paid the creator. The creator is responsible for the service itself; we are responsible for the platform, the payment and the guarantees in section B6. Creators confirm to us that they offer paid services and products as part of their trade or profession (section C1), so consumer law applies to your contract with them.
  • Physical products from a creator’s shop are sold and sent to you by the creator, under a contract between you and the creator. As for services, Quelper collects the payment for the creator as their agent and is responsible for the platform, the payment and the guarantees in section B6 (section B4).
  • Tips are voluntary payments to a creator, which we collect for the creator. You get nothing in return for a tip.

Your card statement. Payments are processed by Stripe. When a creator’s Stripe account is outside the United States, Canada, the United Kingdom, the European Economic Area and Switzerland — or, for any creator, if Stripe cannot tell us the creator’s country at the moment you check out — that account settles the card payment, so the creator’s name appears on Stripe’s payment page and on your card statement (Privacy Policy, section 2.6). This changes who processes the card payment, not who you contract with.

A3. Your account

  • You must be at least 18 and able to enter into a contract. By creating an account you confirm this.
  • Give accurate details and keep them up to date. Keep your password safe and tell us at once if someone else may have used your account. You are responsible for what is done through your account, unless it was not your fault.
  • An account is for one person and cannot be transferred. If you act for a business, you confirm that you may bind it.
  • You can change your username once. You may not use a name you have no right to or pretend to be someone else; we may change a username that does.

A4. Content rules

You are responsible for what you publish, send or sell on Quelper (“your content”). It must be lawful, and it must not:

  • infringe anyone’s copyright, trademark, privacy or other rights;
  • contain sexual content involving minors, pornography or sexual services, terrorist content, violence, hatred against people because of who they are, harassment or threats;
  • be fraudulent or misleading — including claims about what a course, service or product will do for someone, such as health or income results, that you cannot back up;
  • offer anything that Stripe does not allow to be sold through it, or anything that is illegal where you or the buyer are;
  • be spam, malware, or an attempt to collect other people’s passwords or payment details;
  • share other people’s personal data without a lawful reason.

The meeting address and any instructions of an in-person service are shown to everyone who opens the listing. Do not put door codes or other private details there.

A5. Reporting illegal content

Anyone can tell us about content on Quelper that they believe is illegal or breaks these terms. Write to s.alekhin@quelper.com with “Content report” in the subject, and include:

  • why you believe the content is illegal or against these terms;
  • where it is: the exact web address, or enough detail for us to find it;
  • your name and email address (not needed if you are reporting child sexual abuse material);
  • a statement that you believe in good faith that the report is accurate and complete.

We confirm that we have received your report, look at it promptly and carefully, and tell you what we decided and how you can challenge the decision. For copyright, see also section A8. If we learn of information that makes us suspect a criminal offence threatening someone’s life or safety, we inform the police or the competent judicial authority.

A6. How we moderate

Moderation on Quelper is done by people. We use no automated tools to decide about content or accounts. We act on reports, on what we notice ourselves and on orders from authorities, and we judge content against the law and these terms, taking into account the rights and interests of everyone involved, including freedom of expression.

What we may do, in proportion to the problem: remove content or make it less visible; remove a listing; suspend payouts connected to the content; suspend or close an account. When we do, we tell the person affected, by email or in their Quelper inbox, what we did, why (the facts and the rule or law concerned), whether it is temporary and how to challenge it — unless the content is commercial spam or the law does not allow us to tell.

To challenge a decision, reply to our message or write to s.alekhin@quelper.com within six months. We look at the decision again with your explanation and reverse it without delay if it was wrong. You can also go to court.

Creators moderate their own communities: the owner of a community can remove posts and members under the community’s rules, which must follow these terms. If a creator removes you from a community you paid for, section B3 applies.

A7. Your content and the licences you give

You keep the rights in what you create. So that Quelper can work, you give Quelper a non-exclusive, worldwide, royalty-free licence to store, copy and adapt your content (for example to resize images or convert videos), to translate it by machine and index it, to create the search data described in our Privacy Policy (section 2.9), to show it to the people who are allowed to see it, and to use the titles, descriptions and cover images of your public listings to promote them on Quelper, in search engines and on social media. Public pages can also be read by search engines and AI crawlers, as our Privacy Policy (section 2.2) explains.

The licence lasts while your content is on Quelper and until backups that contain it expire. It continues after that only for buyers who still have access to what they bought from you (section B4), and for what you posted in other people’s conversations, such as comments, where removing it would break the conversation — unless you ask us to remove it and the law gives you that right.

Other users may view your content only within the access they have, for their own use. They may not copy, resell or publish it elsewhere without your permission.

If you are a consumer and stop using Quelper, you can ask us for a copy of the content you provided or created on Quelper. We prepare it by hand and send it free of charge, within one month, in a commonly used, machine-readable format. This does not cover content that has no use outside Quelper, that relates only to how you used Quelper, or that we have combined with other data and cannot separate without disproportionate effort.

A8. Copyright notices

If you believe content on Quelper infringes your copyright, send a report as in section A5 and also: identify the work you believe is infringed; state that you own the rights or are authorised to act for the owner, and that the information in the report is accurate; and sign it (typing your full name is enough). If the report is well founded, we remove or disable the content and tell the person who posted it, who can reply with an explanation (a counter-notice). We close the accounts of people who repeatedly infringe other people’s rights.

A9. Using Quelper fairly

  • Do not try to get into accounts, data or parts of Quelper you are not allowed to access, or to get around how access is checked, for example to paid content.
  • Do not overload or attack Quelper, and do not reverse-engineer it except where the law allows you to.
  • Automated access is allowed only to public pages and only as our robots.txt permits — never to members-only or paid content, and never to collect personal data.
  • Do not use Quelper to send spam or unsolicited advertising.
  • Quelper’s software, design and name belong to us. These terms give you the right to use Quelper, nothing more.

A10. How listings are ranked

On the discovery pages (communities, services, courses and products), without a search query, listings are ordered by the number of reviews, then the average rating, then the number of members, then whether the listing has a description and a cover image. When you search, listings are first found by matching your query with the listings’ texts in two ways — by meaning, which an AI model compares, and by keywords — and then put in order by a model. In that order, how well a listing matches your query counts by far the most, and its rating comes next; whether it has an image, its number of reviews, whether it is in your language, the length of its description, its price (mid-range prices rank slightly higher than very low or very high ones) and its type count much less. Nobody can pay for a better position.

Quelper does not currently let buyers post reviews, and we do not check that the ratings shown on listings come from people who bought or used what is listed. Some communities are examples that Quelper created to show how the platform works; they cannot be joined.

A11. Changes to Quelper and to these terms

We may change these terms or Quelper only for one of these reasons: a change in the law or in what an authority requires; to keep Quelper secure or to stop abuse; to add features or improve existing ones, without reducing what you have already paid for; a change of payment or hosting provider, or of what such a provider requires; or to make the terms clearer. We tell you by email at least 30 days before a change to these terms takes effect — at least 15 days for the parts that apply to creators (section C9) — and we keep the earlier version.

A change that is to your disadvantage does not apply to a period you have already paid for. If you do not accept a change, you can end the contract before it takes effect — cancel your membership, close your account — and get back what you paid for the time after that. If we change something you are paying for in a way that harms you more than a little, you can end the contract within 30 days from our notice or from the change, whichever is later, and get back what you paid for the rest of the period.

A12. Suspending and closing accounts

You can stop using Quelper at any time. To have your account erased, write to us (Privacy Policy, section 7).

We may suspend or close an account, or limit what it can do, only for one of these reasons: a serious or repeated breach of these terms; illegal content or activity; fraud, such as paying with someone else’s card, buying and refunding the same item again and again, or referring yourself; a risk to the security of Quelper or to other people; an order from an authority; or, with at least 30 days’ notice, because we stop offering Quelper or the part of it concerned. Unless the law or other people’s safety does not allow it, we tell you in advance, with our reasons, and you can explain.

When we close an account, we cancel its memberships and refund what you paid for any period or access you can no longer use — for a lifetime package or a course, as section B4 says. If we close it because of your fraud, we may deduct the loss that the fraud caused us and that we can show, such as a card payment disputed and lost. You can ask for a copy of your content (section A7).

A13. Liability

If you are a consumer, we are responsible for foreseeable loss or damage that we cause by breaking these terms or by not using reasonable care and skill. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, for wilful misconduct or gross negligence, or under consumer law, including the legal guarantee in section B7. For a service that a creator provides or a physical product that a creator sells, the creator is responsible for it (section A2); we remain responsible for our own obligations, such as handling the payment and the guarantees in section B6.

If you use Quelper for business, including as a creator, our total liability to you in any 12 months is limited to the fees Quelper kept from your sales in those 12 months, or €100 if that is more, and we are not liable for lost profits or indirect loss. This does not limit liability that the law does not allow to be limited, or money we owe you under section C4 or Part D. You will compensate us for claims by others that arise from your content or your sales, unless the claim is our fault.

A14. Law and courts

These terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory consumer law of the country where you live, and you can bring a claim in the courts of that country. If you use Quelper for business, the courts of Madrid, Spain, decide disputes. These terms contain no arbitration clause and no waiver of class or collective actions.

A15. Complaints and dispute resolution

If something goes wrong, write to s.alekhin@quelper.com, in the support chat on Quelper, or by post to our postal address (section A1). We confirm that we have received your complaint, give you a reference for it and answer within 15 days.

If we cannot resolve a complaint from a consumer, we tell you in writing whether we will take part in an alternative dispute resolution procedure. We are not currently a member of Spain’s Consumer Arbitration System (Sistema Arbitral de Consumo) or of any other dispute resolution scheme. You can also contact the consumer office where you live — in Spain, your town’s consumer information office (OMIC) or your region’s consumer authority — and, for a complaint across borders within Europe, the European Consumer Centres Network (ECC-Net). The EU online dispute resolution platform closed on 20 July 2025.

A16. Other terms

  • These terms are written in English. The information for consumers in Spanish at the end of these terms has the same force as the English text. If it, or a translation we publish, differs from the English text, the version more favourable to you applies if you are a consumer; otherwise the English text applies.
  • We send notices to the email address of your account or to your Quelper inbox, and notices of changes to these terms (section A11) always by email; you send them to s.alekhin@quelper.com.
  • We may transfer our rights and obligations under these terms to a company that takes over Quelper, if that does not reduce your rights as a consumer; we will tell you. You may not transfer yours without our agreement.
  • If a court finds part of these terms invalid, the rest stays in force. If we do not enforce a right at once, we have not given it up.
  • Events outside our reasonable control, such as an outage of our payment or hosting providers, excuse a delay for as long as they last; we tell you and refund what you paid for anything we cannot provide.

Part B — Buying on Quelper

B1. How a purchase works

You choose a membership plan, a course, a product or a service package (for a service, also the date) on Quelper, and sign in or create an account. You are then taken to Stripe’s payment page, which shows what you are buying, the total price and, for a membership, that it is charged every month and, after a free trial, the date and amount of the first charge, with a link to these terms; for a physical product, it also asks for your delivery address. There you can check and correct what you entered, or go back, before you press the button to pay. The contract is made when the payment goes through or, for a membership that starts with a free trial, when you start the trial. Right after it you get access on Quelper (memberships, courses, digital products) or a booking (services), or, for a physical product, the creator prepares to send it (section B4); your purchases show in your account.

These terms are always at quelper.com/terms, and earlier versions are kept. On request we send you, by email, the details of your order with the version of these terms and the guarantees that applied to it. Contracts are made in English; the main information for consumers is also given in Spanish at the end of these terms.

B2. Prices and payment

  • The price shown before you pay is the total you pay for the item — for a membership, for each month — including any taxes and, for a physical product, delivery. Nothing is added at checkout; your bank may charge you for converting currency.
  • Creators set the prices, in the currency they choose. A membership plan bought on a creator’s profile page or blog, rather than in a community, is the exception: it is charged in US dollars, even if the plan shows its price in another currency. Stripe’s payment page shows the exact amount and currency before you pay, and the amount on that page is the price you pay.
  • If you buy or join with a partner’s link or code, you get 10% off — for a monthly membership, on every monthly payment for as long as it runs. Section D1 says what it applies to; there is never a partner discount on lifetime packages or tips.
  • You pay by card on Stripe’s payment page; we never see your card number.
  • If a payment fails, or you dispute it with your bank, access to what it paid for may stop until it is settled.

B3. Monthly memberships

  • A monthly membership has no fixed end: it renews automatically and is charged at the start of each monthly period until you cancel.
  • Free trial. The first time you join a community on a paid monthly plan, the first 7 days are free, and the monthly price is charged to your card when the trial ends, unless you cancel before. If you have been a member of that community before, other than on a free guest pass, there is no trial. Lifetime packages have no trial.
  • Cancelling. You can cancel yourself at any time in the community’s Subscription panel, without contacting anyone. You keep access until the end of the period you have already paid for and are not charged again; if you cancel during the trial, you are not charged at all. Cancelling does not by itself refund the current period; sections B5 to B7 say when you get money back. A membership plan bought on a creator’s profile page, rather than in a community, cannot yet be cancelled on Quelper: write to us and we cancel it within one working day, and refund any payment taken after your request.
  • Changing plan. You can change plan in the same panel, which shows what you will pay before you confirm.
  • Price. The price of a membership you have does not go up while it runs. If the creator changes the price of a plan, the new price applies to new members, and to you only if you change plan.
  • Free places. A creator may give you a free place: an invitation, a guest pass or a founding member’s place. It costs nothing and nothing is ever charged automatically; a guest pass ends on the date shown, and the creator can end a free place at any time.
  • If the creator removes you, the community closes, or we close the creator’s account, we cancel your membership and refund the part of your last payment that covers the time you can no longer use. We do this by hand for now: if it has not happened within 7 days, or you are charged again, write to us — we also refund any payment taken after you lost access.
  • Closing a community. We tell the members of a community with paid plans at least 30 days before it closes, unless it has to close sooner because of illegal content, a risk to people’s safety, an order from an authority or a serious breach of these terms by the creator.
  • If you deactivate your Quelper account, ask us to erase it, or we close it (section A12), we cancel your memberships, and any payment taken after that is refunded.

B4. Lifetime packages, courses and products

  • A lifetime package is a one-time payment for access to a community for as long as that community runs on Quelper. It does not renew, and there is nothing to cancel. Before the community closes, we tell you at least 30 days in advance, with the exceptions in section B3. If it closes within 12 months after you bought the package, for any reason other than a breach of these terms by you — for example because the creator closes it, because we close it or the creator’s account, or because we stop offering Quelper — you get back part of the price, in proportion to the months left of those 12.
  • A course you buy is yours to use for 12 months from the purchase, even if the creator stops selling it. If you lose access before the 12 months end because the creator deletes the course or we close the creator’s account, we refund the price in proportion to the months left. If you bought a course on or before 10 September 2026, when the course page said “Full Lifetime Access”, your access does not end after 12 months; if it ends for one of those reasons, we refund you as for a lifetime package. If the course is also open to the members of a community you belong to, you can use it there for as long as your membership gives you access.
  • A digital product is a file you buy. If you do not receive it, write to us and we send it or refund you.
  • A physical product is sold and sent to you by the creator (section A2), and its price includes delivery. You give your delivery address on Stripe’s payment page; the creator sees it on Quelper with your order and uses it only to send you the item and handle a return. The creator sends the item within 30 days of your purchase, unless the listing gives another date; if it has not arrived by then, or the creator does not deliver to your address, you can cancel and get all your money back.

B5. Your right to withdraw within 14 days

If you are a consumer, you can withdraw from a contract made on Quelper within 14 days, without giving a reason.

  • Memberships, courses and digital products: 14 days from the day of the purchase. For a membership that starts with a free trial, 14 days from the day you joined; you have this right once per membership, not again at the first charge. Starting to use a course, a file or a community within the 14 days does not end this right: we do not ask you to give it up at checkout.
  • Services provided by a creator: 14 days from the booking. If the service is to start within those 14 days, we ask you at booking to request that it starts before they end. If you made that request and then withdraw, you pay for the part of the service provided until you tell us, in proportion to the total price; once the service has been fully provided, you can no longer withdraw. If you did not make that request, you get a full refund when you withdraw within the 14 days, even if the service has already been provided. There is no right of withdrawal for leisure services on a set date: tours, excursions and the other services listed under Tours & Sightseeing. Their booking page says so before you pay, and the creator’s cancellation terms apply to them (section B8).
  • Physical products: 14 days from the day you, or someone you name other than the carrier, receive the item. Send it back to the creator within 14 days of telling us that you withdraw; we tell you the address. You pay the direct cost of sending it back, and for any loss in value caused by handling the item more than you needed to see what it is and whether it works.

How to withdraw: tell us before the 14 days end — by email to s.alekhin@quelper.com, with your name, the email address of your account and what you are withdrawing from, or with the model form at the end of these terms. You do not have to give a reason.

What happens then: we refund everything you paid for that contract, including standard delivery — for a service you asked to start within the 14 days, less the part already provided — within 14 days of your message, to the card you paid with, at no cost to you. Your access ends, and a membership is cancelled. For a physical product, we may wait to refund until the item is back or you show us that you have sent it.

B6. Quelper guarantees

These are promises that Quelper LLC (c/o Legalinc Corporate Services Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, USA) makes in addition to your rights under the law, which they do not reduce. They apply wherever Quelper is offered. We handle them by hand: write to s.alekhin@quelper.com from the email address of your account, or in the support chat, and tell us what you bought. We refund within 14 days of your request, to the card you paid with.

  • 7-Day Satisfaction Guarantee. It covers the first payment of a membership: for a monthly membership (section B3), the first monthly payment — if the membership starts with a free trial, the first charge after the trial — and for a lifetime package (section B4), its price. If you are not satisfied, ask within 7 days of that payment and you get it back in full, with no questions asked; the membership is then cancelled. It does not cover later monthly payments, courses, products, services or tips: for them you keep your right of withdrawal (section B5), the shop guarantee below for shop products, and the legal guarantee (section B7).
  • 30-day money-back guarantee on shop products. For a product bought from a creator’s shop on Quelper — a file or a physical item — you can ask for a full refund within 30 days of buying it or, for a physical item, of receiving it. A physical item has to be sent back to the creator, and we also refund what you paid to send it.

Tips are not purchases and are not covered.

B7. The legal guarantee

If you are a consumer, what you buy must match its description and work as it should. If it does not, tell us — for a service or a physical product, tell the creator or us. We or the creator will fix it, or replace a physical product; if that is not possible or does not happen within a reasonable time, you can have the price reduced or end the contract and get your money back. For a course or a file, this covers faults that show within two years of when you got it; for a physical product, within three years of delivery; for a membership and other continuing access, for as long as you have access. The law of your country may give you more.

B8. Services by creators

The creator’s listing describes the service, its date or how a date is agreed, where it takes place — in person, by video call (for example Zoom or Google Meet), or as files delivered to you — and the creator’s cancellation terms. Those terms come on top of your rights in sections B5 to B7 and cannot reduce them: a listing that says “No refund after booking” means only that the creator’s own policy gives no refund when you cancel, not that you lose those rights. If the creator cancels or does not turn up, you get a full refund. If a listing shows no cancellation terms, or says “Ask the creator”, you can cancel free of charge up to 24 hours before the start.

B9. Tips

A tip is a voluntary payment to a creator. You get nothing in return, so sections B5 to B7 do not apply to it. If you sent a tip by mistake, write to us within 7 days and we refund it.

Part C — Creator terms

This part applies when you sell on Quelper or run a community with paid plans (“creator”). It is part of these terms: you accept it when you become a creator, and we record which version you accepted. If you are established in the EU and sell to people in the EU, it is also our terms and conditions under the EU Platform-to-Business Regulation (EU) 2019/1150.

C1. Becoming a creator

  • You must be at least 18. To be paid through Stripe, Stripe must accept your Stripe account; if it does not, or Stripe does not work in your country, we pay you as section C4 says. Payment processing for creators is provided by Stripe under the Stripe Connected Account Agreement, which includes the Stripe Services Agreement; by connecting a Stripe account you accept it, and you allow us to share with Stripe the information it needs about you and your sales.
  • By publishing a paid listing or a paid plan, you confirm that you offer it for purposes of your trade, business, craft or profession. You follow the law that applies to it, including consumer law towards buyers and the rules of your profession, for example for health-related services.
  • You are responsible for taxes on your income from Quelper and for any registration your activity needs. You do not add tax to the price of digital access sold through Quelper (section A2).
  • Where the law requires it, for example the EU DAC7 rules for services, we may ask you for tax details and pass them to the tax authorities.

C2. What you license to Quelper

For digital access (memberships, courses and digital products), you grant Quelper a non-exclusive licence to make your content available to buyers and members and to resell access to it, for as long as you sell it on Quelper and, after that, for as long as buyers keep access under section B4. You keep all rights in your content; Quelper gets no rights in it beyond this licence and the licence in section A7. You confirm that you hold the rights needed for what you sell and that selling it is lawful.

C3. Fees

  • Quelper keeps 15% of the list price of each sale, and you get 85%. There is no monthly fee and no set-up fee. Card processing fees are paid by Quelper out of its 15%.
  • When a buyer pays with a partner’s link or personal code (section D1), the buyer pays 10% less and the partner gets 25% of the list price. Both come out of your share, so on that sale you get 50% of the list price — for a monthly membership, on every payment while it runs. A partner’s code works on any of your sales — monthly community plans, services, products and membership plans on your profile — except lifetime packages and tips, and on your courses only if you allow partners to promote them. It does not need to be a code for your community or your item: any partner’s personal code, entered at checkout, works. The same split applies when a buyer comes from a partner’s recommendation of one of your courses, services or products on the partner’s profile.
  • Scouts (section D2) are paid out of Quelper’s 15%, never out of your share.
  • When Stripe converts currency, for example from the buyer’s currency into your payout currency, its conversion fee comes out of the amount it converts, so you may receive slightly less than 85%.
  • We tell you about any change to fees at least 15 days in advance (section C9).

C4. Payouts

  • Through Stripe. Your share of each payment goes to your Stripe account when the buyer pays, and Stripe pays it out to your bank on your Stripe payout schedule.
  • Paid by us. Money from sales made before your Stripe account could receive payments, or while you have no Stripe account that can — for example because Stripe does not work in your country — reaches Quelper first. It becomes payable 30 days after the buyer’s payment; the wait covers refunds and disputes. We pay it by a transfer to your Stripe account if it is in the United States, Canada, the United Kingdom, the European Economic Area or Switzerland, and otherwise by bank transfer from our account at Mercury. We may pay it without being asked; in any case we pay it within 14 days after you ask, once it is payable. Conversion and bank fees on the route may reduce what you receive.
  • Partner and scout commissions are paid as in Part D.

C5. Refunds, guarantees and disputes

When a buyer gets money back — under the right of withdrawal, a Quelper guarantee or the legal guarantee, because you removed them or closed your community, or because you cancelled or did not provide a service or a product — the refund comes out of your share: we take back your share of that payment (Stripe calls this a reverse transfer), and Quelper gives back its own fee. Note what this covers: under the 7-Day Satisfaction Guarantee (section B6) a buyer can get back the first payment of a membership — the first monthly payment or the price of a lifetime package — within 7 days of it; and the right of withdrawal (section B5) gives a full refund within 14 days even after a course or file has been used, and after a service has taken place unless the buyer asked at booking for it to start within the 14 days (then they pay for what was provided); tours and excursions on a set date (Tours & Sightseeing) have no right of withdrawal. If a buyer disputes a card payment with their bank and the dispute is lost, we may take back your share and the dispute fee. If your Stripe balance is not enough, we may deduct the amount from later payouts. We tell you each time, with the reason.

C6. Rules for creators

  • Publish only material you own the rights to or have the right holder’s permission for. You are responsible for its content and for the accuracy of what you state about it. If you give someone else access to your account, for example an assistant, you are responsible for what they publish and do through it as if you had done it yourself. Each time you publish your creator page, a course, a product or a service, switch on a community plan, publish one of these again after taking it down, or change the listed price of one of these while it is on sale, we ask you to confirm this, and we keep a record of the confirmation (Privacy Policy, section 2.18).
  • Describe what you sell honestly, deliver it as described and on time, and answer buyers’ questions.
  • Deliver on Quelper what buyers pay for on Quelper: content, lessons, files and community access are hosted on Quelper. Exceptions: videos you embed from YouTube or Vimeo, live sessions by video call (Zoom, Google Meet or similar), services in person, files you deliver by link as part of a service, and physical products you send — as long as the purchase and payment happen on Quelper.
  • Do not ask buyers or members to pay you outside Quelper for something offered on Quelper, and do not move paying members to payments elsewhere. Buyer protection, our guarantees, moderation and the fee that keeps Quelper running work only for sales made on Quelper. You may sell the same things elsewhere, on any terms, and link to your own website and social profiles.
  • You can set your community’s rules and remove members who break them. If you remove a paying member, tell us: we cancel their membership and refund the unused part of their last payment (section B3), which comes out of your share.
  • Show cancellation terms on your services. If you show none, buyers can cancel free of charge up to 24 hours before the start (section B8).
  • If you sell physical products, send the item to the delivery address the buyer gave at checkout, which you see in Payouts, under your customers’ payments, within 30 days unless your listing says otherwise; use that address only to send the item and handle a return; and take the item back as sections B5 and B6 say. If you do not deliver to the buyer’s address, tell us, and we cancel the purchase with a full refund.
  • Do not offer anything that section A4 does not allow.

C7. Your members’ and buyers’ data

What you see. As a community owner: your members’ names, usernames, photos and profiles, their plan, its price, their status and dates, how they joined, when their subscription renews and its Stripe reference numbers, and, while they are visible on the member map, the town they saved on it. As a seller: each buyer’s name or username, what they bought, the amount and the fees, the reference number of any partner involved and, for a physical product, the delivery name and address. If your Stripe account settles the card payment (section A2), Stripe may also show you payment details, such as the buyer’s email address and card details, in your Stripe dashboard. You do not receive buyers’ or members’ email addresses from Quelper (Privacy Policy, sections 2.5 and 2.6), and you get no access to other data that Quelper holds about your buyers and your sales. What Quelper itself collects and keeps about you, your listings and your sales, and with whom it shares it, is set out in the Privacy Policy, sections 2 to 6.

Joint controllers. Inside your community, you and Quelper are joint controllers of your members’ personal data (Article 26 GDPR). Our arrangement is this: Quelper decides how Quelper’s features work and keeps them secure, gives members the information in our Privacy Policy, answers members’ requests about their rights and handles personal-data breaches on the platform; you decide who may join and which features of your community are switched on, and you run your community within these terms. If a member asks you to exercise a right about their data, forward the request to s.alekhin@quelper.com within 5 days and help us answer it. Members can contact either of us.

Outside Quelper, what you do with data you saw on Quelper is your own responsibility as a controller. You may use it only to run your community and provide what you sold, in line with data protection law: do not export member lists, do not market to members outside Quelper without their consent, and do not sell or pass on their data. Delete what you copied when you no longer need it for that.

Creators outside Europe. If you are in a country outside the European Economic Area that the European Commission has not recognised as protecting personal data adequately, then for personal data of people in the EEA, the United Kingdom and Switzerland that you receive through Quelper, the standard contractual clauses for transfers between controllers (Commission Implementing Decision (EU) 2021/914, Module 1) form part of these terms, with you as data importer and Quelper LLC as data exporter. For these clauses: the optional docking clause (clause 7) and the optional wording in clause 11 are not used; the competent supervisory authority (clause 13) is the Spanish AEPD; the clauses are governed by Spanish law (clause 17), and disputes go to the courts of Madrid, Spain (clause 18). Annex I is completed by this section and by sections 2.5 and 2.6 of our Privacy Policy (the data, the people concerned, the purpose: running your community and providing what you sold; the transfer: continuous, by your access to Quelper). Annex II: you keep the data secure with measures suited to the risk — at least, only you and the people who help you run your community can see it, and you protect your accounts with a strong password and two-step sign-in where available. For data about people in the United Kingdom, the UK International Data Transfer Addendum to the EU standard contractual clauses (version B1.0, issued by the UK Information Commissioner) applies, with the parties, clauses and annex information set out here, and neither party may end it under its Table 4. For data about people in Switzerland, references to the GDPR include the Swiss Federal Act on Data Protection, and the Swiss Federal Data Protection and Information Commissioner is also a competent authority. If these clauses conflict with anything else in these terms, the clauses prevail.

C8. Restricting, suspending or closing your creator account

  • We may restrict your listings or payouts, or suspend or close your creator account, only for the reasons in section A12, because a listing breaks section A4 or C6, or because Stripe closes or restricts your Stripe account.
  • If we restrict or suspend, we tell you by email at the same time, with our reasons: the facts and the rule concerned.
  • If we end our contract with you completely, we tell you by email, with our reasons, at least 30 days in advance — unless a legal obligation requires us to end it in a way that leaves no time for that notice, we have an imperative reason to end it at once under the law that applies (such as fraud, illegal content or a risk to buyers’ safety), or you have repeatedly broken these terms.
  • You can reply with your explanation. If we find we were wrong, we undo the measure without delay.
  • We keep back only the payouts needed to cover refunds and disputes connected to the reason, and release the rest.

C9. Changes

We tell you by email about changes to these terms that affect you as a creator at least 15 days before they take effect, and longer if you need more time to adapt your offers. During that time you can end your contract with us. Changes do not apply to the past. You can accept a change earlier by publishing a new listing or plan, unless the change is about how much you earn.

C10. Leaving Quelper

You can stop selling at any time by unpublishing your listings and plans. Before you close a community with paying members, tell us at least 30 days in advance, so that members get the notice in section B3: members are refunded as in section B3 and lifetime package holders as in section B4, and buyers of your courses keep their access for the period in section B4. Your Stripe account stays yours; you close it with Stripe. After you leave, we keep order and payout records for tax and accounting (Privacy Policy, section 6), and you can ask for a copy of your content and your sales data.

C11. Complaints

Write to s.alekhin@quelper.com with any complaint about how Quelper treats you as a creator. We reply within 15 days. Quelper is a small enterprise, so the Platform-to-Business Regulation does not require it to run a formal complaint-handling system or to name mediators; we do not currently name any.

Part D — Partners and scouts

D1. Partners

  • Share your partner link or personal code, or recommend a course, service or product on your profile. A buyer who pays with your code, or who comes from your link or your recommendation, gets 10% off, and you earn 25% of the list price of each payment they make — for a monthly membership, every month while it runs. Your code is not tied to one community or item: entered at checkout, it works on any purchase on Quelper except those listed below. A code from a link is remembered in the buyer’s browser for 30 days (Cookie Policy, section 4.2).
  • Not covered: lifetime packages, tips, courses whose creator has not allowed promotion, and purchases by you, by the creator, or by the same person through another account.
  • Commission becomes payable once at least three different people have bought through you, and 30 days after each payment. We pay it within 14 days after you ask, in the way section C4 describes for money paid by us. A refunded or disputed payment cancels its commission.
  • Say clearly that it is a partner link and that you earn from it — for example “partner link” or “#ad”. Do not spam or mislead.

D2. Scouts

A scout who invites a creator to Quelper earns a share of the fee Quelper keeps on that creator’s sales: from a fifteenth of the fee at level 1 to a third of it at level 5. The level rises with the number of invited creators who have actually sold something. It is paid out of Quelper’s fee, never out of the creator’s share, within 14 days after you ask, in the way section C4 describes for money paid by us; your scout dashboard shows what you have earned. This Part D replaces the separate Scout Program terms that were shown at quelper.com/scout_tos (last updated 15 January 2026); that page now points here.

D3. Changes and ending

We may change or end these programmes with at least 15 days’ notice. Commission already earned is still paid. We may withhold commission obtained by breaking these terms, for example by referring yourself or by spam — that commission and no other.

Este apartado recoge en castellano la información principal de estas condiciones para los consumidores. Tiene el mismo valor que el texto en inglés; si difieren, se aplica la versión más favorable para ti (sección A16).

1. Quiénes somos

Quelper (quelper.com) es un servicio de Quelper LLC, sociedad de responsabilidad limitada constituida conforme a las leyes del Estado de Delaware (EE. UU.), inscrita en la División de Sociedades de Delaware con el número 10022353, y dirigida desde Madrid. Dirección postal: c/o Legalinc Corporate Services Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, USA (domicilio social en Delaware, en su agente registrado). Correo electrónico: s.alekhin@quelper.com; si tienes cuenta, también el chat de soporte de Quelper, que atiende una persona. Puedes escribirnos en español, inglés o ruso.

2. Quién te vende y qué

  • Las membresías de comunidades (mensuales o paquetes vitalicios), los cursos y los productos digitales (archivos) te los vende Quelper LLC.
  • Los servicios que un creador presta personalmente (en persona, en directo o en forma de archivos que prepara para ti) y los productos físicos te los presta o vende el creador, mediante un contrato entre tú y él; Quelper cobra el pago por cuenta del creador, como su agente. El creador responde del servicio o del producto; Quelper, de la plataforma, del pago y de las garantías del punto 7.
  • Las propinas son pagos voluntarios a un creador; no recibes nada a cambio.

Los pagos los procesa Stripe. Si la cuenta de Stripe del creador está fuera de Estados Unidos, Canadá, el Reino Unido, el Espacio Económico Europeo y Suiza, o si Stripe no nos indica su país en el momento del pago, esa cuenta liquida el pago con tarjeta y en tu extracto aparece el nombre del creador. Eso no cambia con quién contratas.

3. Precio, pago y celebración del contrato

  • El precio que ves antes de pagar es el total que pagas (en una membresía, cada mes), con todos los impuestos y, en un producto físico, con el envío. No se añade nada al pagar; tu banco puede cobrarte por el cambio de divisa.
  • Un plan de membresía que compras en la página de perfil o en el blog de un creador, y no en una comunidad, se cobra en dólares estadounidenses, aunque el plan muestre su precio en otra moneda. La página de pago de Stripe te muestra el importe exacto y la moneda antes de pagar, y el importe de esa página es el precio que pagas.
  • Pagas con tarjeta en la página de pago de Stripe, donde puedes revisar y corregir los datos antes de pulsar el botón de pago. Esa página enlaza estas condiciones, indica en una membresía con prueba gratuita la fecha y el importe del primer cobro y, en un producto físico, te pide la dirección de entrega. Nunca vemos el número de tu tarjeta.
  • El contrato se celebra cuando se completa el pago o, en una membresía con prueba gratuita, cuando empiezas la prueba. Se celebra en inglés; esta información en castellano tiene el mismo valor. Previa petición, te enviamos por correo electrónico los datos de tu pedido con la versión de estas condiciones y las garantías aplicables.
  • Si pagas con el enlace o el código de un socio (partner), tienes un 10 % de descuento, salvo en paquetes vitalicios, propinas y cursos cuyo creador no lo permite.

4. Membresías mensuales

  • No tienen fecha de fin: se renuevan y se cobran automáticamente al principio de cada mes hasta que las canceles. Su precio no sube mientras la membresía siga activa.
  • La primera vez que te unes a una comunidad con un plan mensual de pago, los primeros 7 días son gratis, y el precio mensual se cobra al terminar la prueba, salvo que canceles antes. Los paquetes vitalicios no tienen prueba.
  • Puedes cancelar tú mismo en cualquier momento en el panel «Suscripción» de la comunidad, sin contactar con nadie. Conservas el acceso hasta el final del periodo pagado y no se te vuelve a cobrar; si cancelas durante la prueba, no se te cobra nada. Un plan comprado en la página de perfil de un creador, fuera de una comunidad, aún no se puede cancelar en Quelper: escríbenos y lo cancelamos en un día hábil, con reembolso de cualquier cobro posterior a tu petición.
  • Si el creador te expulsa, la comunidad cierra o cerramos la cuenta del creador, cancelamos tu membresía y te devolvemos la parte de tu último pago que corresponde al tiempo que ya no puedes usar. Por ahora lo hacemos a mano: si no ha ocurrido en 7 días o se te vuelve a cobrar, escríbenos y te devolvemos también cualquier cobro posterior a la pérdida del acceso.
  • Avisamos a los miembros de una comunidad con planes de pago al menos 30 días antes de su cierre, salvo que deba cerrar antes por contenido ilícito, un riesgo para la seguridad de las personas, una orden de una autoridad o un incumplimiento grave del creador.
  • Si desactivas tu cuenta, nos pides que la borremos o la cerramos nosotros, cancelamos tus membresías y te devolvemos cualquier cobro posterior.

5. Paquetes vitalicios, cursos y productos

  • Un paquete vitalicio es un pago único por el acceso a una comunidad mientras esa comunidad funcione en Quelper; no se renueva ni hay nada que cancelar. Te avisamos al menos 30 días antes de su cierre, con las excepciones del punto 4. Si cierra en los 12 meses siguientes a tu compra por cualquier motivo que no sea un incumplimiento tuyo, te devolvemos la parte del precio proporcional a los meses que falten hasta los 12.
  • Un curso es tuyo durante 12 meses desde la compra, aunque el creador deje de venderlo. Si pierdes el acceso antes porque el creador lo borra o porque cerramos su cuenta, te devolvemos la parte proporcional del precio. Los cursos comprados hasta el 10 de septiembre de 2026 inclusive, cuando la página decía «Full Lifetime Access», no caducan a los 12 meses; si el acceso termina por uno de esos motivos, te reembolsamos como en un paquete vitalicio.
  • Un producto digital es un archivo; si no lo recibes, te lo enviamos o te devolvemos el dinero.
  • Un producto físico te lo vende y envía el creador, y su precio incluye el envío. Indicas la dirección de entrega en la página de pago de Stripe; el creador la ve en Quelper con tu pedido y solo la usa para enviarte el producto y gestionar una devolución. Lo envía en un plazo de 30 días desde la compra, salvo que el anuncio indique otra fecha; si no ha llegado en ese plazo, o el creador no envía a tu dirección, puedes cancelar la compra y recuperar todo tu dinero.

6. Derecho de desistimiento

Si eres consumidor, puedes desistir de un contrato celebrado en Quelper en un plazo de 14 días naturales, sin indicar el motivo.

  • Membresías, cursos y productos digitales: 14 días desde la compra; en una membresía con prueba gratuita, desde el día en que te uniste (una sola vez por membresía, no de nuevo con el primer cobro). Empezar a usar el curso, el archivo o la comunidad no te hace perder este derecho.
  • Servicios de un creador: 14 días desde la reserva. Si el servicio empieza dentro de esos 14 días, al reservar te pedimos que solicites expresamente que empiece antes de que terminen. Si lo solicitaste y después desistes, pagas la parte del servicio prestada hasta que nos lo comuniques, en proporción al precio total; una vez prestado el servicio por completo, ya no puedes desistir. Si no lo solicitaste, tienes reembolso íntegro al desistir en los 14 días aunque el servicio ya se haya prestado. No hay derecho de desistimiento en los servicios de ocio con fecha fija: visitas guiadas, excursiones y los demás servicios de la categoría Tours & Sightseeing. Su página de reserva lo indica antes del pago, y en ellos rigen las condiciones de cancelación del creador.
  • Productos físicos: 14 días desde el día en que tú, o la persona que indiques distinta del transportista, recibes el producto. Devuélveselo al creador en los 14 días siguientes a comunicarnos el desistimiento (te indicamos la dirección). Corren de tu cuenta el coste directo de la devolución y la disminución de valor que resulte de una manipulación distinta de la necesaria para ver qué es y si funciona.

Para desistir, comunícanoslo antes de que acaben los 14 días: por correo electrónico a s.alekhin@quelper.com, con tu nombre, el correo electrónico de tu cuenta y el contrato del que desistes, o con el formulario de abajo. Te devolvemos todo lo que pagaste por ese contrato, incluido el envío estándar (en un servicio que pediste empezar dentro de los 14 días, menos la parte ya prestada), en un plazo de 14 días desde tu comunicación, con la misma tarjeta y sin coste para ti; tu acceso termina y la membresía se cancela. En un producto físico podemos esperar a recibirlo o a que acredites que lo has enviado.

7. Garantías comerciales de Quelper

Quelper LLC (c/o Legalinc Corporate Services Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, USA) ofrece estas garantías además de tus derechos legales, que no quedan afectados, en todos los países donde se ofrece Quelper. Para usarlas, escríbenos a s.alekhin@quelper.com desde el correo electrónico de tu cuenta, o por el chat de soporte, e indica qué compraste. Te devolvemos el dinero en un plazo de 14 días desde tu petición, en la misma tarjeta.

  • Garantía de satisfacción de 7 días (7-Day Satisfaction Guarantee): cubre el primer pago de una membresía: en una membresía mensual, la primera cuota (si empieza con una prueba gratuita, el primer cobro al terminar la prueba), y en un paquete vitalicio, su precio. Si no estás satisfecho, pide el reembolso en los 7 días siguientes a ese pago y te lo devolvemos íntegro, sin preguntas; la membresía se cancela. No cubre las cuotas posteriores, los cursos, los productos, los servicios ni las propinas: para ellos conservas el derecho de desistimiento (punto 6), la garantía de la tienda para sus productos y la garantía legal (punto 8).
  • Garantía de devolución de 30 días en productos de la tienda (30-day money-back guarantee): por un producto comprado en la tienda de un creador en Quelper, un archivo o un artículo físico, puedes pedir el reembolso íntegro en los 30 días siguientes a la compra o, si es físico, a su recepción. El artículo físico se devuelve al creador y te reembolsamos también lo que pagaste por devolverlo.

Las propinas no son compras y no están cubiertas.

8. Garantía legal

Lo que compras debe ajustarse a su descripción y funcionar como debe. Si no es así, avísanos (en un servicio o un producto físico, al creador o a nosotros): se reparará o, si es un producto físico, se sustituirá; si no es posible o no se hace en un plazo razonable, puedes obtener una rebaja del precio o resolver el contrato y recuperar tu dinero. Plazos: en cursos y archivos, faltas de conformidad que se manifiesten en los dos años siguientes a su entrega; en productos físicos, en los tres años siguientes a la entrega; en membresías y demás accesos continuos, mientras dure el acceso. La ley de tu país puede darte más.

9. Servicios y propinas

El anuncio del creador describe el servicio, su fecha o cómo se acuerda, dónde se presta (en persona, por videollamada o mediante archivos que te entrega) y sus condiciones de cancelación. Esas condiciones se suman a tus derechos de los puntos 6 a 8 y no los reducen: «No refund after booking» significa solo que la política del creador no prevé reembolso cuando cancelas. Si el creador cancela o no se presenta, recibes el reembolso íntegro. Si el anuncio no muestra condiciones de cancelación, o dice «Ask the creator», puedes cancelar gratis hasta 24 horas antes del inicio. Una propina no da derecho a nada a cambio; si la enviaste por error, escríbenos en un plazo de 7 días y te la devolvemos.

10. Reclamaciones, ley aplicable y tribunales

Escríbenos a s.alekhin@quelper.com, por el chat de soporte o por correo postal a nuestra dirección. Confirmamos la recepción, te damos un número de referencia y respondemos en un plazo de 15 días. No estamos adheridos al Sistema Arbitral de Consumo ni a ningún otro sistema de resolución de litigios; si no resolvemos tu reclamación, te diremos por escrito si participaremos en uno. Puedes acudir a la oficina municipal de información al consumidor (OMIC) o a la autoridad de consumo de tu comunidad autónoma y, para reclamaciones transfronterizas en Europa, a la Red de Centros Europeos del Consumidor (ECC-Net). Estas condiciones se rigen por la ley española; como consumidor conservas la protección de las normas imperativas de consumo del país donde vives y puedes reclamar ante sus tribunales.
